Avrah® — Software License Agreement and Terms of Service

1. Grant of License

Home SeTV® S.r.l. (“Licensor”) grants you (“User”) a limited, non-exclusive, non-transferable, revocable license to install and use A.V.R.A.H.® on a number of devices consistent with the license type you have acquired (Free or Premium). This license is granted solely for lawful purposes and in accordance with this Agreement.

2. Ownership and Intellectual Property

A.V.R.A.H.® is owned by Home SeTV® S.r.l. and protected by copyright, trade secrets, patents, trademarks, and other intellectual property rights. You acknowledge that all rights, title, and interest in A.V.R.A.H.® remain exclusively with Home SeTV®. You may not: Copy, modify, adapt, translate, or create derivative works of A.V.R.A.H.®. Reverse engineer, decompile, or attempt to access source code. Rent, sublicense, transfer A.V.R.A.H.® to third parties. Seek intellectual property protection based on A.V.R.A.H.® or its components.

3. Restrictions of Use

You may not use A.V.R.A.H.®: In any illegal or unlawful manner. To defame, harass, or violate the rights of others. In hazardous activities (e.g., driving, operating machinery) where malfunctions could cause harm. In critical systems where failure could threaten lives or property.

4. Updates and Modifications

Home SeTV® may provide updates, enhancements, or new features to A.V.R.A.H.®. These are subject to this Agreement. Home SeTV® reserves the right to modify or discontinue any feature without notice.

5. Warranty Disclaimer

A.V.R.A.H.® is provided “as is,” without warranty of any kind. Home SeTV® makes no representations or guarantees that the software will be error-free, uninterrupted, or meet your specific needs.

6. Limitation of Liability

To the maximum extent permitted by law, Home SeTV® shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, revenue, or profits arising from use of A.V.R.A.H.®. Total liability shall not exceed the amount actually paid by the User for the license.

7. Termination

This Agreement remains in effect until terminated. You may terminate by uninstalling A.V.R.A.H.®. Home SeTV® may terminate immediately if you violate these terms.

1. Acceptable Use

When using A.V.R.A.H.® you agree not to: Use the software for fraudulent, harmful, or illegal activities. Upload or transmit copyrighted material without authorization. Compromise the security or operation of A.V.R.A.H.® or related services.

2. Account & Access

Some features may require user registration. You are responsible for safeguarding your login credentials. Misuse of accounts may result in suspension or termination.

3. Payments & Licensing

Certain features require a paid license (monthly or annual). Your subscription will automatically renew at the end of each billing period unless you cancel through your Account Settings before the renewal date. You will receive confirmation when cancellation is processed. Under EU consumer protection law (Directive 2011/83/EU) and the Italian Consumer Code, you have the right to withdraw from your subscription within 14 days of purchase for a full refund, provided you have not yet used the service. After this period, payments are non-refundable unless required by applicable law. Payment processing is handled by Stripe, Inc. (stripe.com). Stripe acts as a data processor and maintains its own privacy policy at stripe.com/privacy.

4. Privacy & Data

Use of A.V.R.A.H.® may involve processing of personal data. Home SeTV® will process data in compliance with applicable regulations (including GDPR). Our Privacy Policy (available at avrah.it/privacy) governs data use in detail. Under GDPR, you have the right to access, correct, export, or delete your personal data. To exercise any of these rights, send an email to info@homesetv.com from the email address associated with your account, specifying your request. You may be asked to provide your username or registration date for identity verification. We will respond within 30 days.

5. Governing Law & Jurisdiction

This Agreement shall be governed by Italian law. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Milan, Italy.

6. Entire Agreement

These terms constitute the entire agreement between the User and Home SeTV® regarding A.V.R.A.H.®. Any failure to enforce a right does not constitute a waiver.
